Farkas v. GGNSC d/b/a Golden Living et al.

Matukaitis Law represented a former nursing home employee in a Family and Medical Leave Act and workers’ compensation retaliation case.  The Employer, Golden Living, filed a Motion to Dismiss, arguing that because the employee had not been employed for 12 months prior to the date of her termination, she was not covered by the FMLA.  Court rejects Employer’s argument, and holds that case can proceed under the FMLA. United States District Court, Middle District of Pennsylvania (December 3, 2012).
