The story behind a federal lawsuit that cancer specialist Dr. Kevin Staveley-O’Carroll is waging over his firing from Penn State Milton S. Hershey Medical Center is pretty straightforward, his lawyer contends.
“It’s a case about a cancer surgeon sticking up for somebody who has cancer,” attorney Lisa Matukaitis said.
That cancer patient was Staveley-O’Carroll’s secretary……
Dutko claimed in the lawsuit that the county had refused to investigate her claim of discrimination and, in fact, retaliated against her for making the claims. She sought unspecified monetary damages and her return to her former job.
A confidential settlement resolved the lawsuit, according to Lisa Matukaitis, a Harrisburg attorney representing Dutko. Neither party can talk about the agreement. “The matter was amicably resolved,” Franklin County Commissioner David S. Keller said…….
The lawsuit, filed Feb. 11 in the U.S. Middle District Court in Harrisburg, seeks unspecified monetary damages and her return to her former job.
Dutko, 56, said she was forced to resign July 9 after asserting her rights under federal and state law, according to the lawsuit. The suit declares her supervisors and the county retaliated because she filed two discrimination complaints each with the Pennsylvania Human Relations Commission and the federal Equal Employment Opportunity Commission…….
